Plaintiff Alexander Floyd (“Floyd”) filed a lawsuit against Apex on behalf of himself and a class of similarly situated applicants for employment, alleging that Apex violated the pay transparency provision of the Washington Equal Pay and Opportunities Act, RCW 49.58.110. The lawsuit, Floyd v. Apex Systems, LLC, is currently pending before the Honorable Maureen McKee in King County Superior Court as Case Number 25-2-03847-5 SEA (the “Lawsuit”).

Floyd is an applicant for employment with Apex who alleges he was denied access to pay and benefits information during the application process. In particular, he alleges the job posting to which he responded did not include a wage scale or salary range and a general description of benefits and other compensation, in violation of RCW 49.58.110. He seeks $5,000.00 in statutory damages for each Class member. Apex denies Floyd’s claims and maintains that it has not violated Washington law. The Court has not made a decision regarding the merits of the Lawsuit.

On July 16, 2026, the Court granted class certification determining the Lawsuit should proceed on a class basis. The Notice is not an expression of any opinion of the Court as to the merits of any claims or defenses asserted by either party. There is no money available at this time and no guarantee that there ever will be.

You received the Notice because you meet the following class definition: “All individuals who applied to the LinkedIn job posting for the Agile Delivery Owner position located in Bellevue between September 12, 2023, through September 26, 2023.”

Your options are explained in the Notice. To be excluded, you must act by September 10, 2026.

Your Legal Rights and Options in this Lawsuit

Do Nothing

Stay in this Lawsuit. Await the outcome. Give up certain rights. By doing nothing, you keep the possibility of getting money that may come from trial or settlement. You will not be able to sue Apex separately about the claims in this Lawsuit and will be bound by the judgment, whether favorable or not.

Ask to Be Excluded From The Lawsuit By September 10, 2026

Get out of this Lawsuit. Get no benefits from it. Keep rights. If you ask to be excluded from the Lawsuit and money is later awarded through trial or settlement, you will receive nothing. You will, however, keep any rights to sue Apex for the same claims in this Lawsuit.

So long as you do not request exclusion, you have the right to hire counsel, who may then enter an appearance on your behalf.
